1. Introduction

Welcome to DirectDoc Telehealth (“DirectDoc,” “we,” “our,” or “us”). These Terms & Conditions gover your access and use of the DirectDoc mobile app, website, and related services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Eligibility

  • You must be 18 years or older (or have parental/ guardian consent if under 18) to use DirectDoc.
  • By using DirectDoc, you confirm that the information you provide is accurate, and that you have the capacity to enter into these Terms.

3. Nature of Services

  • DirectDoc is a telehealth facilitation service. It provides access to licensed healthcare professionals, health information, and digital tools.
  • DirectDoc does not replace emergency medical care. If you have a medical emergency, call your local emergency number immediately.
  • The Platform may provide general health guidance, but should not be regarded as a substitute for an in-person medical examination where clinically required.

4. User Responsibilities

You agree to:

  • Provide complete, and accurate information.
  • Use the Platform only for lawful purposes.
  • Not misuse, copy, resell, or tamper with the Platform.
  • Follow all applicable laws, and regulations in your jurisdiction.

5. Privacy & Data Security

We take privacy seriously.

  • Data Collection: We may collect personal data (e.g., name, email, health information you choose to share) for the purposes of providing healthcare services.
  • Data Usage: Your data, is used only to provide, and improve services, comply with legal obligations, and for internal analytics.
  • Data Sharing: We will never sell personal data. Limited sharing may occur with:

Licensed healthcare professionals (for your care).

Service providers (IT, hosting, payment processors).

Authorities (only if legally required).

  • Data Security: We implement industry-standard encryption, and safeguards to protect your information.
  • Storage: Data may be stored securely in compliance with South African POPIA GDPR (where applicable), and HIPAA principles (if cross-border services apply).

6. Telehealth Disclaimers

  • Medical outcomes cannot be guaranteed.
  • Responsibility for following healthcare advice rests with the patient.
  • DirectDoc, and its providers are not liable for:

Misuse of the Platform.

Inaccurate, or incomplete information provided by users.

Technical failures outside our reasonable control.

 

7. Subscriptions & Payments

  • Fees for services (including GP consults, mental health, allied health, or subscriptions) are displayed transparently before payment.
  • All transactions comply with Apple App Store, and Google Play Store payment policies.
  • No refunds unless required by law.

8. Intellectual Property

  • All content, trademarks, and software on DirectDoc remain the exclusive property of DirectDoc, or its licensors.
  • Users may not copy, reproduce, or distribute without written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • DirectDoc, its affiliates, and providers are not responsible for indirect, incidental, or consequential damages arising from use of the Platform.
  • We do not warrant uninterrupted, or error-free service.

10. Indemnity

You agree to indemnity, and hold harmless DirectDoc, its directors, employees, and partners against any claims, damages, or liabilities resulting from the misuse of the Platform, or violation of these Terms.

11. Third- Party Services

The Platform may contain links or integrations with third- party services (e.g., pharmacies, labs). DirectDoc, is not responsible for third-party actions, services, or privacy practices.

12. App Store & Google Play Compliance

 

If downloaded via the Apple App Store, you acknowledge:

  • These Terms are between you and DirectDoc, not Apple.
  • Apple, has no responsibility for the app, or its content.
  • Apple, is not liable for any claims relating to the app, including product liability, compliance, or consumer protection.
  • You will comply with applicable App Store Terms of Service.

If downloaded via Google Play Store, you acknowledge:

  • These Terms are between you and DirectDoc, not Google.
  • Google, has no responsibility for the app, or its content.
  • Google, is not liable for any claims relating to the app, including product liability, compliance, or consumer protection.
  • You will comply with applicable Google Play Store Terms of Service.

13. Termination

DirectDoc may suspend, or terminate your access to the Platform, if you violate these Terms, misuse services, or engage in fraudulent activity.

14. Governing Law

These Terms are governed by the laws of South Africa, without prejudice to mandatory consumer protection laws in your jurisdiction.

15. Changes to Terms

We may update these Terms& Conditions, and Privacy Policy from time to time. Updates will be posted on the Platform with the new “Last Updated” date. Continued use after changes constitutes acceptance.
